McLean was called to the Bar in Johannesburg in December 2008, and became a member of the Group at the same time. Prior to joining the Bar, McLean completed BMus and LLB degrees at Wits, where she received the Society of Advocates Prize for the Most Distinguished Graduate for the degree of LLB in 2001. After graduating, she worked as a research clerk for Justice O’Regan at the Constitutional Court of South Africa in 2002 and was also a part-time lecturer at Wits in 2002 and 2003. From 2003 to 2007, Kirsty worked as a public-sector consultant, specialising in, amongst other areas, housing and local government law. During the same period, she completed a DPhil at Magdalen College, Oxford with a thesis on the role of the judiciary in the interpretation and enforcement of socio-economic rights in South Africa. Kirsty has published widely in public law, and is the author of Constitutional Deference, Courts and Socio-Economic Rights in South Africa (2009). In addition to her work at the Bar, Kirsty is a Visiting Senior Fellow at the Centre for Applied Legal Studies, School of Law, University of the Witwatersrand, where she continues to publish and give occasional guest lectures. McLean’s areas of practice include general commercial law, public law, constitutional law, administrative law, pension fund law, medical schemes law, labour law, unlawful competition, and competition law.
